- The applicant, whether a natural person or a legal entity, represented by the undersigned, as the duly authorised representative, in the context of the present Technical Assistance Facility , hereby declares that:
- The applicant has the legal mandate and operational capacity as described in the application;
- The applicant certifies that all institutional and legal information provided in the request form is accurate and current;
- The applicant has the professional competencies, technical expertise, and access to relevant stakeholders necessary to support the successful implementation of the proposed assistance;
- The applicant undertakes to actively cooperate with the Technical Assistance Facility and designated experts throughout the planning, delivery, and follow-up of the support received;
- The applicant will provide timely feedback, relevant documentation, and other inputs as requested to facilitate the effective provision of technical assistance;
- The applicant respects and protects intellectual property rights related to the project, its outputs, and any third-party materials and confirms that it owns the intellectual property rights in the documentation provided as part of the application and/or has obtained permission to use any third-party content (if any) included in the application;
- The applicant grants IUCN, a non-exclusive, perpetual, worldwide, royalty-free, sublicensable licence to use the documentation including any Intellectual Property Rights thereof submitted by the applicant for the purposes of reviewing and assessing the technical assistance request in accordance with the Call for Technical Assistance Request Guidelines in line with the mission and statutory objectives of IUCN. For the avoidance of doubt, IUCN may share the documentation with the funding donor, partners, or consultants engaged by IUCN to implement the Project and/or provide the technical assistance.
- The applicant understands that this Facility provides technical assistance only (not financial support), and no funds will be transferred to the applicant as part of this process;
- The applicant confirms it is not acting as an intermediary and will be the direct beneficiary and point of contact for the requested support;
- the applicant is not in any of the situations listed below. Should the applicant be found to be in one of these situations, IUCN reserves the right to withhold or terminate assistance:
Is bankrupt, subject to insolvency or winding-up procedures, or has entered into an arrangement with creditors; is under suspension of business activities or is the subject of legal proceedings related to professional misconduct; has been found guilty of grave professional misconduct proven by any means; has engaged in fraud, corruption, or other criminal activities in the context of development cooperation or environmental projects.
